Epilepsia y trabajo: Riesgos y limitaciones. Una revisión desde la Legislación Preventiva Española

RESUMEN

La epilepsia es un trastorno caracterizado por cambios crónicos, recurrentes y paroxísticos de la función neuronal producidos por anomalías en la actividad eléctrica cerebral. En el mundo del trabajo interesa la valoración preventiva del trabajador epiléptico para compatibilizar su integración laboral, con la seguridad en el desempeño del trabajo, sin que suponga riesgos para sí mismo o para otros y para realizarla deben considerarse múltiples factores: la propia enfermedad, el modo en que se presenta, las medidas terapéuticas aplicadas, el trabajo que realiza y capacidad laboral del trabajador, los riesgos laborales, la forma de afrontar la situación y actitud de la persona ante la patología. Estas competencias corresponden a la medicina del trabajo. En España existen una serie de profesiones con normativas legales específicas restrictivas, que excluyen al paciente con epilepsia, considerando dicha enfermedad incompatible con el desempeño de estas actividades. Conseguir la integración laboral sin riesgos requiere conocer tanto las condiciones clínicas y laborales del afectado y la normativa existente. Se trata de conseguir una actuación conjunta y ajustada a criterios comunes por parte de todos los sanitarios implicados.

ABSTRACT

Epilepsy and work: Risks and limitations. A review of the Spanish Preventive Legislation

Epilepsy is a disorder characterized by chronic, recurrent and paroxysmal neuronal function caused by abnormal electrical brain activity changes. What we are interested at laboral world it is the preventive evaluation of epileptic workers to reconcile their employment, security in job performance, without incurring risk to patients or others. To perform this valuation multiple factors must be considered: the disease itself and how it is presented, therapeutic measures, the work done and the work capacity of the worker, occupational hazards, how to cope and attitude the person with the disease. These skills correspond to the occupational medicine. In Spain there are a number of professions with specific restrictive legal regulations, which exclude the patient with epilepsy, considering that disease incompatible with the performance of these activities. Achieving maximum safe workplace integration requires knowledge of the clinical and social conditions of affected and existing regulations and, therefore, a joint action and common criteria set by all involved health.
